The issue that I see time and time again in my estate planning and estate management practice is that in reality many estate plans simply don’t work. There are many reasons why estate plans fail, ranging from inadequate and out of date documents, to overlooking how assets are titled, to not properly planning for disability and incapacity, to forgetting to update beneficiary designations, to failing to properly address family problems and dynamics, and failing to consider non-probate assets.
I encourage clients to do the following when assessing the adequacy of their estate planning: First consider goals, concerns and motivations, then address reality, family dynamics and consider enforceability and do-ability. It is difficult to do the above without getting good, accurate, current, and user friendly information from a professional who knows what they are talking about!
